Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your use of ImaMeshi ("the App"), provided by ZAWA SYSTEM ("the Operator"). By using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

2. Account

The App signs you in anonymously through Firebase Authentication at first launch. You may optionally sign in with an Apple account or a Google account and link those credentials to your anonymous account.

• You must not share your authentication credentials with any third party
• If you discover unauthorized use of your account, please contact the Operator promptly
• You may delete your data on the server and discontinue use of your account at any time using the "Delete account" feature in the Settings screen

3. Service Description

The App is a mobile application that recommends "what to eat now" from restaurants, chain eateries, and convenience stores near your current location, designed primarily for solo diners who frequently eat out. It provides:

• Nearby restaurant search via the HotPepper Gourmet Search API
• Supplementary display of chain restaurants and convenience stores sourced from the OpenStreetMap Overpass API
• Filtering and sorting of recommendations based on favorite genres, allergies, disliked ingredients, budgets, and preferred shop types (adjustable anytime in Settings)
• Variety score computed from meal history
• "Today's pick: this one shop" selection
• Disclosure of selection basis (search radius, budget, preferences, preferred shop types, etc.)
• Meal logging (shop name and category auto-filled when logging from shop detail), favorite shops, and monthly spending tracking
• OSM tile map on the shop detail screen and address supplementation via Nominatim
• AI-based (Vertex AI Gemini grounding) retrieval and display of brand product information (new, limited-time, seasonal, and signature items) on the shop detail screen
• Authentication upgrade via Apple account / Google account
• Subscription and one-time purchase billing via RevenueCat

4. Pricing Plans

The App offers a free plan ("Free") and a paid plan ("Pro").

Subscribing to the Pro plan unlocks the features listed above. Additional features added in the future (e.g., home-screen widgets, weekly summaries) may be exclusive to the Pro plan.

5. Subscription and One-Time Purchase

• The Pro plan is offered as either a monthly subscription (JPY 100/month, tax included) or a one-time lifetime purchase (JPY 1,000, tax included). Prices may change. Any price change applies to new subscriptions and to renewals on or after the effective date; for existing monthly subscribers, the prior price remains in effect through the end of the current billing period. Price changes will be announced reasonably in advance via in-app notification or by updating this page.
• Payments are processed through the Apple App Store or the Google Play Store and are subject to each platform's terms. The Operator does not directly obtain or retain payment information such as credit card details.
• The monthly subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• To cancel auto-renewal, please use the subscription management screen of the App Store or Google Play Store on your device.
• Even after cancellation, you may continue to use Pro features until the end of the current billing period.
• The one-time purchase is paid in full at the time of purchase, with no auto-renewal. Pro features remain available for as long as the App continues to be provided.
• In-app purchases are deemed mail-order sales (provision of electronic services) and are not subject to cooling-off under the Japanese Specified Commercial Transactions Act. Refunds follow the policies of Apple or Google.
• Where a free trial period is offered, you will be automatically transitioned to a paid subscription at the end of the trial unless you cancel beforehand.

6. Advertising

On the Free plan, the App displays advertisements provided by Google AdMob (banner ads and in-feed native ads). No advertisements are shown on the Pro plan. For details on how advertisements are handled, the use of advertising identifiers (IDFA / AAID), and App Tracking Transparency (ATT) on iOS, please refer to the Privacy Policy.

7. Handling of Shop Data

• The App uses the HotPepper Gourmet Search API provided by Recruit Co., Ltd. We display the "Powered by HotPepper Gourmet" credit on the recommendation results screen.
• The App uses data retrieved from OpenStreetMap's Overpass API, Nominatim, and tile servers. OpenStreetMap data is provided under the ODbL license; we display the "© OpenStreetMap contributors" attribution within the App and on this site.
• The App uses information such as brand official URLs fetched from the Wikidata API. Wikidata data is provided under the CC0 license.
• Shop information, business hours, addresses, coordinates, and official URLs are as obtained at retrieval time from each data source; we do not warrant their currency, accuracy, or completeness. Please verify actual shop status with the shop.
• The App may introduce affiliate links (for example, "Visit official site" on the shop detail screen) in the future. Where introduced, the locations and labels will be clearly indicated in accordance with applicable laws (e.g., the Japanese Act against Unjustifiable Premiums and Misleading Representations, the Specified Commercial Transactions Act).

8. AI Features

• On the shop detail screen, the App uses Gemini on Vertex AI via Cloud Functions to retrieve and display new, limited-time, seasonal, and signature products of the brand to which the shop belongs (e.g., Matsuya, Yoshinoya, 7-Eleven).
• AI-generated content is provided for reference only and we do not warrant its currency, accuracy, or completeness. Please verify actual availability, prices, and participating shops at each shop or the official website.
• AI feature processing is subject to the Google Cloud Service Specific Terms and the Vertex AI generative AI data governance policy. Google Cloud does not use customer data sent to Vertex AI to train its generative AI models.
• AI results are stored as a shared per-brand cache (the brands/{key} collection) for up to 7 days and are served to other users referencing the same brand.

9. Location Data

The App uses location (GPS) to search for nearby shops. Location is accessed only while the App is in the foreground; the App does not collect or continuously track location in the background. The location itself is not stored in Firestore or any other database; it is used only as a request parameter (latitude, longitude, radius) sent to Cloud Functions when fetching recommendations. If you deny location permission, the recommendation feature is unavailable, but other features remain fully usable.

10. Content

• The App displays shop information retrieved from external APIs and databases such as OpenStreetMap. The Operator does not create, control, or warrant such content.
• Copyrights and other rights in each data source belong to the respective content providers (Recruit Co., Ltd., OpenStreetMap contributors, Wikidata contributors, etc.).
• We do not warrant the currency or accuracy of shop information, prices, or business hours. Please verify with the shop or the official website before relying on it.
• The Operator is not responsible for the outcome of meals or transactions at shops you visit via the App.

11. Prohibited Activities

You must not:

• Engage in conduct that violates laws or public order and morals
• Misuse the App, reverse-engineer, decompile, disassemble, or use automated tools to issue large volumes of requests
• Circumvent rate limits or bypass the Free-plan daily recommendation limit through unauthorized means
• Acquire or use the subscription or one-time purchase plan through fraudulent means
• Interfere with the App's servers or the external APIs used by the App (HotPepper Gourmet Search API, OpenStreetMap, Wikidata, Vertex AI, etc.)
• Infringe the rights of the Operator or any third party
• Use the App for commercial purposes without prior permission of the Operator
• Engage in any other conduct that the Operator reasonably deems inappropriate

12. Disclaimer

The App is provided on an "as is" basis. Features such as shop data retrieval, recommendation, map display, and AI-generated product information have inherent limits, and the Operator makes no express or implied warranties as to the completeness, accuracy, reliability, or fitness for a particular purpose of the App.

Except where prohibited by applicable law, the Operator shall not be liable for any damages (including, without limitation, dissatisfaction with the meal, damages incurred during shop visits, loss of data, loss of opportunity, or secondary harm) arising from use of, inability to use, content from external APIs, or third-party services (Firebase, RevenueCat, Google AdMob, Google Cloud (including Vertex AI), HotPepper Gourmet Search API, OpenStreetMap, Wikidata, etc.). This limitation does not apply where the damage is caused by the Operator's willful misconduct or gross negligence, or where the limitation is invalidated in whole or in part by mandatory consumer protection laws (including Article 8 of the Japanese Consumer Contract Act).

Where the Operator is liable under applicable law or these Terms, except in the cases set forth in the preceding paragraph (including the Operator's willful misconduct or gross negligence, and cases where this paragraph is invalidated in whole or in part by mandatory consumer protection laws), such liability shall be limited to ordinary damages (excluding lost profits and damages arising from special circumstances) and shall not exceed the total amount paid by the user to the Operator in connection with the App during the twelve (12) months preceding the event giving rise to the claim (JPY 1,000 for users on the free tier).

13. Intellectual Property

Intellectual property rights in the design, logo, source code, and other content created by the Operator for the App belong to the Operator or the rightful owner. You must not reproduce, modify, or redistribute such content without the prior consent of the Operator. Rights to data retrieved from external APIs and OpenStreetMap belong to their respective providers and are used in accordance with their respective licenses.

14. Account Suspension and Deletion

If you violate these Terms, or if the Operator reasonably determines that suspension is necessary for the safe operation of the App, the Operator may suspend the account or delete the user's data without prior notice.

15. Changes to and Discontinuation of the Service

The Operator may modify, add, remove, suspend, or discontinue the App at any time without prior notice. Some features may become unavailable due to changes in third-party services such as Firebase, RevenueCat, Google AdMob, Google Cloud (including Vertex AI), the HotPepper Gourmet Search API, OpenStreetMap, or Wikidata. If the App is discontinued, the Operator will give reasonable advance notice and will, where practicable, offer means for users to review or delete their data.

16. Changes to Terms

These Terms constitute standard terms of contract (teikei-yakkan) under Article 548-2 paragraph 1 of the Japanese Civil Code, intended to provide the App to many users on uniform conditions. The Operator may amend these Terms in accordance with Article 548-4 of the Japanese Civil Code only where (i) the amendment conforms to the general interest of users, or (ii) the amendment does not contradict the purpose of the App and is reasonable in light of the necessity of the change, the appropriateness of the amended terms, the fact that this section anticipates such amendments, and other relevant circumstances.

Material changes will be announced reasonably in advance through in-app notification or by updating this page, together with the content of the amended Terms and the effective date. Minor changes take effect upon posting on this page. If you continue to use the App after the effective date of the changes, you are deemed to have agreed to the amended Terms.

17. Privacy

For the handling of personal information, please refer to the Privacy Policy. By agreeing to these Terms, you also consent to the collection, use, and third-party sharing of information described in the Privacy Policy.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
